Record of Decision

Decision Taken By: CABINET
Decision No: D120132CAB
Date: 10th October 2012

Decision(s) and Reason(s)

Peters Pit, Wouldham - Consultation by Marine Management Organisation and Service of Compulsory Purchase Order

Minutes

The report sought authority to respond to a formal consultation by the Marine Management Organisation in respect of a licence application by the developer of the site. Consideration was also given to the reaffirmation of the decision taken in March 2011 to serve a Compulsory Purchase Order (CPO) to secure the construction of a bridge from the A228 to the Peters Pit development site (Decision No D110051CAB refers).

A supplementary report circulated at the meeting updated the position regarding various bodies' responses to the consultation and the drafting of the Statement of Reasons for service of the CPO. Thanks were recorded to all involved in progressing this matter.

The Cabinet resolved that:
1) no objection be raised in respect of the consultation from the Marine Management Organisation (subject to no key adverse responses arising from other consultees on matters that would be of direct relevance to the local planning authority); and
2) the decision to serve a Compulsory Purchase Order, as authorised in March 2011, be reaffirmed.

Reasons: As set out in the joint report of the Director of Planning, Transport and Leisure and Chief Solicitor.

Signed Chief Executive: D Hughes
